JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner apprehends his arrest in Khaira P.S. Case No.65/15 for the offences under Sections 341, 323, 504, 365, 120(B), 420 and 366 of the I.P.C.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that on 28.2.2015 when there is none in the house of the informant all the accused persons including the petitioner kidnapped married daughter, Sunaina Devi, of the complainant/informant to get her married with Mantu Yadav. When the informant came to the accused persons to take the victim return, the accused persons threatened to kill him and told that the marriage of the victim has already been
Patna High Court Cr.Misc. No.28881 of 2015 (2) dt.24-07-2015 2/2 solemnized with Mantu Yadav.
It has been submitted on behalf of the petitioner that main allegation has been made against one Lalita Devi by the victim herself in her statement recorded under Section 164 Cr.P.C. The petitioner has no criminal antecedent.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within six months from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C. J.M., Jamui, in Khaira P.S. Case No.65/15 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
