Heard Mr. Prabhat Ranjan Singh, learned counsel for the petitioner and Mr. Anuj Kumar Srivastava, learned counsel for the State.

The petitioner, who is in custody since 22.09.2017 seeks bail in connection with Jhajha P.S. Case No. 06/2014 dated 10.01.2014 instituted for the offence under Sections 341, 323,

386, 504 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Though, the allegation in the First Information Report is of causing disturbance in execution of public work and threatening the members of the construction team but it has been submitted that the allegations are absolutely false. The petitioner has several cases to his credit, which fact has been stated in paragraph -3 of the petition. However, learned counsel for the petitioner submits that in most of the cases, he has been acquitted and in some of the cases he has not even been remanded. He submits that only because of his antecedents, he has been made accused in this case.

One of the accused persons with similar allegation has been granted bail by a Bench of this Court.

Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be

released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate - Jamui in connection with Jhajha P.S. Case No. 06/2014. However, it is made clear that if at all the petitioner is found to indulge in similar activities, the bail granted to the petitioner would be rendered liable to be cancelled.
