2. The petitioner seeks bail in connection with Udwant Nagar P.S. Case No. 419 of 2021 instituted for the offences under Sections 304(B), 201 and 34 of the Indian Penal Code.
3. As per allegation in the FIR, petitioner along with his family members has tortured in various ways to the daughter of the informant due to non-fulfillment of Rs. two lac and a motorcycle and ultimately petitioner in connivance with other family members has killed her and with a view to wipe off the evidence, thrown her dead-body near railway track.
4. This is the third attempt of the petitioner for grant
Patna High Court CR. MISC. No.17554 of 2025(4) dt.01-07-2025 2/3 of bail. Earlier the petitioner had moved before a Co-ordinate Bench of this Court with a prayer for bail which was rejected vide order dated 03.08.2023 passed in Cr. Misc. No. 18387 of 2023. Again, the petitioner moved before the same Co-ordinate Bench this Court with a prayer for bail which was also rejected on merit vide order dated 02.05.2024 passed in Cr. Misc. No. 13008 of 2024.
5. In compliance of the earlier order of this Court dated 16.05.2025, a report dated 22.05.2025 with regard to the present stage of trial has been received which has been kept at Flag 'B'.
6. From perusal of the aforesaid report sent by the learned court below, it appears that out of six charge-sheeted witnesses, five witnesses have already been examined and only Investigating Officer is remain to be examined and the next date fixed is 27.5.2025.
7. Learned counsel for the petitioner submits that the petitioner is languishing in judicial custody since 03.11.2021 without cogent reason.
8. Having heard learned counsel for the parties and taking into account that the trial is at an advance stage as only Investigating Officer remains to be examined, this Court is not
Patna High Court CR. MISC. No.17554 of 2025(4) dt.01-07-2025 3/3 inclined to grant bail to the petitioner at this stage.
9. Accordingly, the prayer for bail of the petitioner is rejected with a direction to the learned court below to expedite the trial and conclude the same expeditiously preferably within a period of two months from today.
10. If the trial is not concluded within a period of two months from today, as stated above, the petitioner will be at liberty renew his prayer for bail before the court below. (Rudra Prakash Mishra, J) rishi/- U T
