JUSTICE ARUN KUMAR ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel appearing on behalf of the informant.

Petitioner, already in custody, seeks bail in connection with Khagaria (Chitra Gupt Nagar) P.S. Case No.366 of 2016, registered under Sections 420 and 419 of the Indian Penal Code. Allegation in brief is that the informant transferred Rs.5,60,000/- in the account of the petitioner and Rs.40,000/- cash was also given to the petitioner for making investment in a fixed deposit on his behalf.

Learned counsel for the petitioner submits that this amount was sent by the informant for the purpose of giving it to his brother-in-law, Ajay Kumar, a co-villager and after withdrawing the amount, the petitioner handed over to him,

Patna High Court Cr.Misc. No.60917 of 2017 (2) dt.19-12-2017 2 /2 moreover the petitioner has clean antecedent, charge-sheet has already been submitted and the petitioner is in custody since 23.09.2017.

Learned counsel for the informant opposes the prayer of bail.

Having considered the said facts and circumstances, let petitioner, Pankaj Kumar Ravi, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria in connection with Khagaria (Chitra Gupt Nagar) P.S.
