The petitioner apprehends her arrest in connection with a case registered for offences punishable under Sections 341, 323, 379, 448, 308 and 504/34 of the Indian Penal Code. It is submitted that the informant had assaulted the petitioner Bhuna Devi on earlier occasion for which Khudaganj P.S. Case No.136/2013 was lodged and in retaliation this case has been filed. There is general and omnibus allegation of assault against all the five accused persons. However, against the petitioner there is allegation that she has taken away one pair of ear ring.

No.39549 of 2014 (2) dt.20-03-2015 2 / 2 Having regard to the facts and circumstances of the case and also the fact that the petitioner is a lady, let the petitioner, namely, Bhuna Devi be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Khudaganj P.S. Case No.69/2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Hilsa at Nalanda subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
