====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date : 05-01-2018 The matter has been placed before this Court on account of non-compliance with the defects pointed out by the office. It is seen that neither the defects have been removed nor anyone appears when the matter is taken up. On the contrary, records indicate that show cause has been filed by respondent No.3 in the matter of settling the P.F. claim of the petitioner and decision with regard to orders to be passed by the D.G.P. under Rule 43A of Bihar Pension Rules.

In view of the above, I have perused the record and dispose of the matter in the following terms:

Patna High Court MJC No.2812 of 2016 dt.05-01-2018 2/3 Show cause filed by respondent No.3 goes to show that with regard to payment of P.F. dues of the petitioner, matter has already been referred to the Accountant General and the petitioner has also been directed to give certain particulars for settlement of his P.F. claim. As far as the order to be passed under Rule 43A of the Bihar Pension Rules is concerned, it is to be passed by the competent authority of the Department, namely, the Director General of Police.

Taking note of the fact that the petitioner has already been directed to give certain details and the Accountant General is also apprised of the position, for the present, without initiating any action for contempt in the matter of refund of amount of P.F., the respondents are directed to settle the claim of the petitioner within a period of two months from the date of receipt/production of a copy of this order.

As far as the passing of an order by the D.G.P. with regard to the eligibility of the petitioner for pension under Rule 43A of Bihar Pension Rules is concerned, if orders have not been passed by the D.G.P. till date, the same be now passed within a period of two months from the date of receipt/production of a copy of this order.
