The petitioner seeks regular bail in connection with Special Case No. 08 of 2017 corresponding to Jogbani P.S. Case No. 34 of 2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code, Sections 30(g) and 38(i) of the Excise Act, Sections 63 and 64 of the Copy Right Act, Sections 27(b) (a) 28 read with Section 36 AC of the Drugs and Cosmetic Act and Sections 20/22 of the N.D.P.S. Case.

The allegation in the present case is regarding recovery of huge quantity of drugs such as Spasmo Proxyvan Plus 8496 Cap., Nitlosun-10-1000 tab., Parvo Cof-495 bottles, Corex cough Syrup350 bottles, Avil 320 Inj,, Diazelab 100 Inj. and Lupigesuc 150

The learned counsel for the petitioner submits that the aforesaid recovery has not been made from his house, he has got a clean antecedent and he is in custody since 15.10.2017. It is further submitted that some of the co-accused persons have already been granted bail by a coordinate Bench of this Court. Considering the nature of accusation, the period of custody already undergone and the fact that he has got a clean antecedent, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Araria in connection with Special Case No. 08 of 2017 corresponding to Jogbani P.S. Case No. 34 of 2017.
