ANJANA MISHRA ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341, 323, 379, 420, 406, 307 and 384 of the Indian Penal Code. Learned counsel for the petitioner submits that in fact the petitioner had given advance to the complainant as he was in land business but on request being made by him for return of the said amount, the complainant became angry and filed the present case. He further submits that all false and frivolous allegations have been made only to grab the taken amount. The petitioner has also filed a case under Section 138 of N.I. Act for return of the cheques which had been issued by the complainant and which had been returned for want of sufficient fund.

No.30841 of 2015 (2) dt.12-08-2015 P2/2 Considering the nature of allegation made against the petitioner and also the fact that the petitioner has no criminal antecedent, let the petitioner Rajkishore Sah, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Chhatauni P.S. Case No. 151/14 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
