JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Yogapatti (Nawalpur) P.S. Case No. 21 of 2014 registered under Sections 20, 22, 24 and 27(A) of the N.D.P.S. Act.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of the telephonic information, informant along with other police officials raided the house of Trubhuwan Prasad and recovered 200 Grams of Charas but later on the police officials, who were the members of raiding party raised suspicion, whose statements have been recorded in paragraphs 8 to 11 of the case diary and seizure list witnesses,

Patna High Court Cr.Misc. No.38180 of 2014 (2) dt.01-04-2015 whose statement have also been recorded in paragraphs 41 and 42 of the case diary, have also raised suspicion showing the involvement of the petitioner in the present case except that there is nothing against the petitioner. It is further submitted that petitioner has no criminal antecedent.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Yogapatti (Nawalpur) P.S. Case No. 21 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
