ANJANA MISHRA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Thakurganj (Powakhauli) P.S. Case No.62 of 2014 for allegedly having committed the offences under Sections 302, 379 and 120B of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have been roped in the present case on the basis of mere suspicion. The admitted position is that none had seen the occurrence and only because there was some dispute between the petitioners' family i.e., father-in-law and the informant, that the names of these petitioners have been brought into the present case.

No.32311 of 2015 (2) dt.18-08-2015 2/2 Considering the aforementioned submissions and the fact that three similarly situated co-accused persons have been extended the privilege of anticipatory bail in Cr.Misc. No.6550 of 2015, vide order dated 19.2.2015 and also that the petitioners have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj, in connection with Thakurganj (Powakhauli) P.S. Case No.62 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
