In this case, the petitioner is seeking bail in connection with Gardanibagh P.S. Case No. 693 of 2019 (Spl. Case No. 235 of 2019) registered for offences under sections 323, 341, 354 (B) (D) of the Indian Penal Code and Section 12 of the POSCO Act.

In the present case, an allegation of teasing has been made against the petitioner by a girl student. When the girl has raised objection, the petitioner started to assault her with the fists and slaps.

In the present case, the mother of the petitioner has filed supplementary affidavit on his behalf in which she has attached an affidavit sworn by the father of the petitioner

Patna High Court CR. MISC. No.19620 of 2020(3) dt.29-06-2020 2/2 wherein he has stated that he will see that in future the petitioner will not indulge in such activity and undertakes that he will mend the activity of the petitioner.

As the petitioner is a college going student and he is in jail custody since 17.11.2019, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional & Sessions Judge1st, Patna in connection with Gardanibagh P.S. Case No. 693 of 2019 (Spl. Case No. 235 of 2019), subject to the condition that (i) one of the bailors shall be the father of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds. (Shivaji Pandey, J) rishi/- U T
