The petitioners pray for bail in a case registered for the offence under Sections 272, 273, 328, 307, 302/34, 120(B) of the I.P.C. and Sections 30(a), 30(c) & 37(b) of Bihar Prohibition and Excise Act.

Petitioners are involved in sale of spurious liquor, which has led to the death of a person.

It is submitted on behalf of petitioners that spurious liquor has not been recovered from the possession of these petitioners. Petitioners claim clean antecedent and are in custody since 02.11.2021.

Patna High Court CR. MISC. No.18616 of 2022(2) dt.26-05-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act (Court No. II), Muzaffarpur in connection with Saraiya P.S.
