Petitioners apprehend arrest in a case registered for the offence punishable under sections 379/307/354A/34 and other ancillary sections of the Indian Penal Code. As per the prosecution case, petitioner no.1 attempted to administer night soil to the wife of the informant, whereas petitioner no.2 and other accused person wrapped rope around the neck of the informant and pulled it.

Learned counsel appearing for the petitioners submits that the present case is counter version of Motihari Muffasil Police Station Case No. 487 of 2022 lodged by petitioner no.1 against informant and others. Injury sustained by the informant

Patna High Court CR. MISC. No.18446 of 2023(3) dt.20-06-2023 2/2 was found to be simple in nature by the doctor. Petitioners are innocent and have falsely been implicated in this case. Petitioners claim clean antecedent.

Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Motihari Muffasil Police Station Case No. 486/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
