JUSTICE MADHURESH PRASAD ORAL ORDER 21-02-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 328, 379 and 34 IPC.

Counsel for the petitioner submits that the name of the petitioner has come in the case on the confessional statement of co-accused as well as his own confession. Prior to the lodging of this case, he is accused in other cases mentioned in paragraph 3 of the bail application. In these cases also, he submits that the petitioner has been made accused on the basis of confessional statement of the said co-accused recorded in Obra Police Station Case No.118 of 2015. In most of these cases, he is on bail. Though as per FIR the petitioner spent some time with the informant, still no effort has been made to identify the petitioner by putting him on T.I.parade. Petitioner is in custody since 25.7.2017.

Patna High Court Cr.Misc. No.63733 of 2017 (3) dt.21-02-2018 2/2 Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Aurangabad Mufassil Police Station Case No. 206 of 2015 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and (b) The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
