The petitioner is in custody since 15.04.2018, in connection with Madhepur P.S. Case No. 35 of 2018, for the offence registered under Sections 395,397 of the I.P.C and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though he is not named in the FIR his name has surfaced in the confessional statement made before the police by co-accused Chandan Mallic @ Chandan Kumar which has no evidentiary value. It is further submitted that co-accused Chandan Mallic@ Chandan Kumar has already been granted privilege of bail in Cr. Misc. No. 42538 of 2018 vide order dated 30.07.2018 and the petitioner case stands on similar footing.

No.46075 of 2018(2) dt.14-08-2018 2/2 In view of the aforementioned submissions and that this petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jhanjharpur, Madhubani, in connection with Madhepur P.S. Case No. 35 of 2018.
