JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Sare PS case no. 105 of 2017 registered for the offences punishable under Section 25(1-b)a/26 of Arms Act. The allegation against the petitioner is that when the police had reached his house, he started fleeing away and after being apprehended, one rifle was recovered from him. The learned counsel for the petitioner submits that the petitioner has a clean antecedent except one case in which, he has already been granted bail and he is languishing in custody since 09.08.2017.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to direct for the release of the petitioner on regular bail immediately upon completion of six
Patna High Court Cr.Misc. No.53513 of 2017 (2) dt.09-11-2017 2/2 months in custody. Accordingly, the petitioner is directed to be released on regular bail immediately upon completion of six months from 09.08.2017 subject to such other conditions as may be imposed by the learned trial court.
