Petitioner seeks bail in Tikapatti P.S. Case No. 57 of 2017 for the offence punishable under Sections 363 and 366(A) of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor girl of informant.

It has been submitted on behalf of the petitioner that the petitioner is handicapped person and can barely walk and the allegation of kidnapping the minor girl is false and fabricated. Learned counsel for the petitioner further submits that the petitioner has been sufficiently penalized and is rotting in jail custody since, 28.05.2017.

The girl in her statement recorded under Section

Patna High Court Cr.Misc. No.52224 of 2017(2) dt.09-11-2017 2/2 164 of the Cr.P.C had stated that the petitioner forcibly took her and left her at his bhabhi house where she was kept for fifteen days. The victim in her statement had further stated that the petitioner did not forcibly tried to do anything. Learned APP for the State opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case as well as the fact that the petitioner is handicapped person, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M. Purnea in connection with Tikapatti P.S. Case No. 57 of 2017.
