Petitioner, already in custody, seeks bail in connection with NDPS Case No. 46 of 2017 arising out of Raxaul P.S. Case No. 129 of 2017 registered under Sections 20, 22, 23, 24 of the NDPS Act.

Accusation in brief is that police stopped a person going on rickshaw at the Indo-Nepal Border and the said person was found carrying a bag and on search 7 Kgs. of Charas was recovered from the bag.

Learned counsel for the petitioner submits that the petitioner is a Rickshaw Puller and has no concern with the Charas.

Having considered the recovery of 7Kgs. Charas of

Patna High Court Cr.Misc. No.48007 of 2018(2) dt.06-08-2018 2/2 commercial quantity from the possession of the petitioner, the prayer of bail is rejected.
