Let the same be done during the course of the day. Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Trivenignaj P.S. Case No. 364 of 2018 registered for the offence punishable under Sections 461, 379 and 411 of the Indian Penal Code.

The allegation is regarding theft having been committed in the shop of the informant and some garments, cash etc. were taken away by the thieves.

The learned counsel for the petitioner submits that

No.17169 of 2019(2) dt.01-04-2019 2/2 the petitioner has been falsely implicated in the present case on the pretext that the informant had recovered some stolen articles from the petitioner and he was seen roaming around the shop in the previous night for a long time. It is further submitted that the petitioner has been roped in the present case merely on suspicion and in fact he is having a clean antecedent and no recovery has been made by the Police from his conscious possession. Lastly, it is submitted that the petitioner is languishing in custody since 21.09.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Triveniganj P.S. Case No. 364 of 2018.
