====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 13-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Choutham P.S. Case No. 22 of 2022 lodged under Sections 147, 148, 149, 341, 326, 307, 504 of the Indian Penal Code read with Section 27 of the Arms Act.

The case of the prosecution is that for making pairvi in the court, the informant visited to the court and was returning at about 7 PM, then accused persons including the present petitioner surrounded the informant and others, then attacked upon the informant, in result injury took place. Learned counsel for the petitioner submits that there is long pending dispute between the informant and the petitioner, in this regard the petitioner side has already filed a criminal case

Patna High Court CR. MISC. No.18486 of 2022(2) dt.13-07-2022 2/3 in Choutham P.S. Case No. 239 of 2021 on 05.11.2021. He further submits that the present case has been filed by the informant in retaliation of the earlier case. He further submits that no arms or ammunition has been recovered from the possession of the petitioner. He further submits that the present petitioner is alleged to be the order giver, he is aged about 62 years old person having no criminal antecedent and languishing in jail since 22.01.2022 and charge sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Alka Rai, Judicial Magistrate-1st Class, Khagaria in connection with Choutham P.S. Case No. 22 of 2022, subject to the conditions as laid down under Section 437(3) of the Cr.P.C. Accordingly, the bail application stands allowed. (Dr. Anshuman, J.) guddu/- U T
