2. The petitioner seeks bail in connection with S.Tr. No. 169 of 2022 arising out of Bhagwan Bazar P.S. Case No. 270 of 2021 registered for the offence under Section 302, 34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner along with other accused persons have killed the deceased Suraj.

4. The petitioner is in custody since 9.12.2021 and in the trial, out of eight witnesses, three witnesses have been examined.

5. In view of the judgment of the Hon'ble Supreme Court in the case of X Vs. State of Rajasthan and Anr. reported in 2024 SCC OnLine SC 3539, this Court is not inclined to

Patna High Court CR. MISC. No.26356 of 2025(4) dt.06-08-2025 2/2 grant bail to the petitioner.
