The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 379, 447, 506 & 307/34 of the Indian Penal Code. While the informant was at Balughat Bahiyara and doing accounting of Munsi and labourer, all the F.I.R. named persons along with ten unknown miscreants including this petitioner is said to have attacked on him with an intention to commit loot-pat. He was severely assaulted by them causing injury on different part of the body. They also snatched away Rs.2,42,300/- from his pocket.

He has been falsely implicated in this case. There is case and counter case between the parties. As a matter of fact, the son of the informant and others badly assaulted the petitioner and his villager Anil Kumar and in order to save their skin they lodged this false and frivolous case against him and others. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The injury sustained by the victim is simple in nature and the said injury report has been annexed as Annexure-3 to this application. It is further submitted that there is no any iota of direct or indirect evidence on record against the petitioner to suggest his involvement in the said occurrence. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

Having regard to the facts and circumstances of the case as well as the fact that no specific overt act has been attributed against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the
