The petitioner seeks bail in Session Trial No. 408 of 2017 arising out of P.S. Case No. Shambhuganj P.S. Case No. 03 of 2017 registered under Section 366/34 of the Indian Penal Code. Petitioner along with other accused persons is suspected of kidnapping wife and son of the informant. It is submitted by learned counsel for the petitioner that there is no evidence against the petitioner indicating his complicity in the occurrence. He has been falsely implicated in the case merely on suspicion. The victims who happen to be wife and son of the informant have also not named the petitioner in the occurrence in their respective statement recorded under Section
Patna High Court Cr.Misc. No.53371 of 2017 (3) dt.12-12-2017 2/2 164 of the Code of Criminal Procedure rather they have stated about acquaintance of the petitioner with them and wife of the informant has also stated that they have no dispute with the petitioner. The petitioner has been languishing in custody since 12.03.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Banka in connection with Sessions Trial No. 408 of 2017 arising out of Shambhuganj P.S. Case No. 03 of 2017.
