The only grievance of the petitioner is that his pension has not been fixed according to 6th Pay Commission but learned counsel appearing for Bank drew my attention towards Annexure-R series to the counter affidavit and submits that the pension of the petitioner has already been fixed according to 6th Pay Commission because earlier petitioner was getting basic amount at the rate of Rs. 7,206/- but his basic amount in pension has been increased to Rs. 18,520/- and the increase of the said amount clearly demonstrates that the pension of the petitioner has already been revised in accordance with 6th Pay Commission.

Patna High Court CWJC No.10907 of 2016 (5) dt.19-08-2017 2/2 Learned counsel for the petitioner submits that Annexure-R series goes to show that the aforesaid revision was made in the month of July, 2017 and there is nothing on the record to show as to whether the arrear of the said revision has been paid to the petitioner or not.

In the aforesaid facts and circumstances, this petition stands disposed of giving direction to respondent Nos. 4 and 5 to calculate all the admitted dues of the petitioner arising out due to revision of his pension and to ensure the payment within three months from the date of receipt/production of a copy of this order, if the same has not already been paid to the petitioner.
