The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 12.01.2022, charge-sheet has been submitted in this case and has antecedent of 16 cases. Allegation is of recovery of 2178.36 litre of liquor from a truck.

The learned counsel for the petitioner submits that the petitioner was not arrested from the spot nearly all the 16 cases are under the Excise Act inn which the petitioner has been continuously implicated falsely and his name is alleged to have

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and was not arrested from the spot and his name was disclosed by the Chaukidar as aforesaid, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Saraiya P. S. Case No.817 of 2020.

The application stands allowed.
