Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Ladaniya P.S. Case No. 175 of 2021 dated 17.06.2021 registered for the offences punishable under Sections 272, 273 and 34 of IPC and Section 30(a) of Bihar Prohibition and Excise Act. 3.

The main submissions advanced by learned counsel for petitioner are that the petitioner is a lady having fair and clean antecedent and she has been languishing in jail since 23.02.2023 and she has been made accused mainly on account of being registered owner of one of the motorcycles which was seized with the alleged wine and one similarly situated co-accused person namely, Ayodhi Mandal, who is also stated to be the

Patna High Court CR. MISC. No.19576 of 2023(2) dt.09-05-2023 2/2 owner of one of the seized motorcycles, has been granted bail by a co-ordinate bench of this Court vide order passed in Cr. Misc. No. 8369 of 2023 and petitioner's case is completely identical to him and against the petitioner the investigation has been completed.

Learned APP for the State opposes the bail prayer of the petitioner and submits that the instant matter relates to recovery of 2403 litres of illicit liquor which was being smuggled by forty smugglers on several motorcycles and petitioner's motorcycle was also used in the alleged crime. 5.

Having considered the above submissions and mainly the facts that the petitioner is a lady and she is stated to be the registered owner of one of the seized motorcycles and she was not arrested at the spot of recovery and against her the investigation has been completed, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Ladaniya P.S. Case No. 175 of 2021.
