2. The petitioners apprehend their arrest in connection with Sonepur P.S. Case No. 900 of 2023 registered under Sections 366A/34 of the Indian Penal Code.

3. As per prosecution case, all the F.I.R. named accused persons including these petitioners kidnapped the minor daughter of informant.

4. Learned counsel appearing on behalf of the petitioners

Patna High Court CR. MISC. No.20415 of 2024(4) dt.31-07-2024 2/2 submits that petitioners are innocent and have falsely been implicated in the present case due to suspicion. Further submission is that the victim girl, in her statement recorded under Section 164 Cr.P.C. has clearly stated that no one has kidnapped her and she has voluntarily married with co-accused Mukesh Kumar. Petitioner nos. 1, 2 and 3 are neighbours of informant and have no concern with the alleged occurrence. Petitioner nos. 4 and 5 are mother and brother of co-accused Mukesh Kumar. Petitioners claim clean antecedent.

5. Having considered the facts and circumstances of the case as well as the statement of victim recorded under Section 164 Cr.P.C., let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 900 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
