JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323 and 380 of the Indian Penal Code.
The accusation is of making assault to the father of the complainant when petitioner no. 1 gave threatening and the accused persons took away the box containing cloths, ornaments, mobile including documents of landed property. It is submitted by the learned counsel for the petitioners that for the occurrence of 10.3.2015 the complaint has been filed
Patna High Court Cr.Misc. No.31742 of 2015 (2) dt.03-08-2015 2/2 on 23.3.2015. The petitioners side lodged Basnahi P.S. Case No. of levelling accusation under sections 341,323,447,448,354,379,504 and 506/34 IPC against the complainant and his parents with regard to an occurrence of 26.2.2015, thereafter the present complaint has been filed. The petitioners are aunt and uncle of the complainant. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM IInd Class, Saharsa in connection with Complaint Case No. 560C of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
