The petitioner in Cr. Misc. No.60869 of 2017 is in custody since 10.10.2017 and petitioner in Cr.Misc. No.60905 of 2017 is in custody since 07.11.2017 in connection with Kurtha P.S. Case No.195 of 2016 registered for the offences
Patna High Court Cr.Misc. No.60869 of 2017 (3) dt.18-01-2018 2/3 under Sections 420, 467, 468, 471, 409 and 120B/34 of the Indian Penal Code.
Diary in the present cases has been called for, which has since been received.
Learned counsel for the petitioners submits that the petitioners being Panchayat Secretaries are Government servants and are not likely to abscond or tamper with the evidence and that they shall appear before the court below as and when required and co-operate in the trial. Considering the nature of allegations made against both the petitioners and they are willing to co-operate in the trial and shall appear as and when required by the court, let both the petitioners be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal, in connection with Kurtha P.S. Case No.195 of 2016, subject to the following conditions:
(1) One of the bailors will be their blood relative, namely, father, mother, brother, sister and/or their wife.
(2) The petitioners shall not indulge themselves in any similar offence till conclusion of the trial.
(3) The petitioners shall remain physically present
Patna High Court Cr.Misc. No.60869 of 2017 (3) dt.18-01-2018 3/3 in court on each and every date during trial and in the event of their failure on two consecutive dates without sufficient reasons, their bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioners shall co-operate with the investigation, if not already concluded, and make themselves available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjana Mishra, J) PNM U T
