13-07-2020 Heard learned counsel for the parties through video conferencing.
The petitioner apprehends his arrest in Chhabilapur P.S. Case No. 138 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per F.I.R., the allegation against petitioner is that he assaulted on the head of informant by iron rod, as a result of which, she (informant) sustained injury. It is further alleged that petitioner snatched gold chain from the neck of informant and also threatened for dire consequences.
It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. There is general and omnibus allegation. In fact, no such occurrence has taken place. It is further submitted that the injury caused to the informant
Patna High Court CR. MISC. No.15906 of 2020(2) dt.13-07-2020 2/2 was found to be simple in nature by the doctor. However, learned A.P.P. for the State opposed the bail application and submits that there is specific allegation against petitioner of assaulting informant by iron rod and in the occurrence, three persons have received injury on their head, which is vital part of the body.
Considering the aforesaid facts and circumstances, the anticipatory bail application stands dismissed. (Prabhat Kumar Singh, J.) anay U T
