Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Bhagwanpur (Vaishali) P. S. Case No.58 of 2025 registered for the offences punishable under Sections 96, 137(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 23-3-2025 and the informant alleges that petitioner along with other named accused persons kidnapper her minor daughter.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner and the victim

No.17926 of 2026(2) dt.07-05-2026 2/3 were in love and they eloped and they performed their marriage, on which the learned APP after perusing the order impugned submits that during the course of investigation victim was recovered along with the petitioner as recorded at para-54 of the case diary, it is next submitted that victim on the date of occurrence was 14 years of age as her date of birth is 10-4-2010 and the statement of the victim was also recorded under Section 183 BNSS, wherein she has supported the case of the prosecution and has stated that petitioner forcefully made her accompany him and also married the victim forcefully and even established physical relation, it is further submitted that victim is supporting the case of the prosecution, on which the learned counsel appearing on behalf of the petitioner submits that petitioner and the victim were recovered together and they have performed their marriage, but under parental pressure, the statement of the victim was recorded, it is also submitted that victim is not a minor.

After hearing the learned counsel for the parties, the Court is not inclined to release the petitioner on bail. 6.
Accordingly, the prayer for bail of the petitioner is rejected.

However, the petitioner would be at liberty to
