JUSTICE SANJAY PRIYA ORAL ORDER 2/ 25-09-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Saharsa Sadar P.S. Case No.259 of 2018 instituted for the offence under Section(s) 341, 323, 384, 379, 467, 468, 471, 420, 504 506/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner has clean antecedents.

In the written report, it is alleged that daughter of sister of the informant's father allowed the accused persons to live in the house and on the land, in question. She told to vacate the house after death of her father, but the accused persons

Patna High Court Cr.Misc. No.49087 of 2018 (2) dt.25-09-2018 2/2 demanded rangdari of rupees five lacs.

Counsel for the petitioner submits that it is a matter of civil dispute. Co-accused, Jay Jay Ram Bhagat, has already filed Title Suit being T.S. No.560 of 2017 in the Court of SubJudge I, Saharsa, regarding the land in question. Counsel for the informant has appeared and opposed the prayer for bail.

Petitioner is said to be in custody since 06.05.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar P.S. Case No.259 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
