Learned counsel for the petitioner, after some argument, submits that he would avail the remedy of appeal. He, however, submits that since the matter has been kept pending for a long time and due to the COVID Pandemic in between, the appellate authority may raise the issue of appeal being delayed.

In view of such submission, this Court would observe that if the appeal is filed within two weeks from today, the appellate authority shall consider the same without raising the

Patna High Court CWJC No.227 of 2022(2) dt.16-09-2022 2/2 issue of the petitioner's claim being barred by delay, by reasoned and speaking order in accordance with law within three months thereafter.
