====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-07-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in Andar P.S. Case No. 119 of 2023 registered for the offences punishable under Sections 366, 447, 448, 379, 341, 323, 504, 506, 34 of the Indian Penal Code.

3. Allegedly, all the accused persons including the petitioner are said to have committed loot in the house of the informant and kidnapped her minor daughter for the purpose of marriage as well.

4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and she has committed no offence. No such occurrence as alleged has ever taken place. She has been falsely implicated in this case due to ulterior motive. She is mother of a breastfeeding baby. The allegation

Patna High Court CR. MISC. No.24196 of 2024(3) dt.12-07-2024 2/3 levelled against the petitioner is totally false and based on concocted facts. Petitioner has no role in the alleged occurrence. He further submits that the statement of the victim recorded under Section 164 Cr.P.C. is totally different from the statement given to police under Section 161 Cr.P.C. No physical or sexual assault has been reported. Petitioner has no criminal antecedent as mentioned in para 3 of the bail application. She is in custody since 23.01.2024 and charge has already been framed against her.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, since the charge has already been framed against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Andar P.S. Case No. 119 of 2023.

7. Petitioner is directed to cooperate in the trial. If the petitioner fails to appear before the learned Court below on two consecutive dates on the date fixed in the case, the prosecution will be at liberty to file an application for
