This application has been filed challenging the order dated 25.07.2013 passed by learned Judicial Magistrate, 1st Class, Patna, in connection with Complaint Case No. 2340C of 2012, by which the learned Magistrate has found a prima facie case against the petitioner to proceed under Sections 406 and 320 of the Indian Penal Code.

Learned counsel for the petitioner informs this Court that in the trial the evidence of the witnesses is going on. In view of the aforesaid, this quashing petition is dismissed.
