JUSTICE SANJAY KUMAR ORAL ORDER 19-12-2017 Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are in custody in connection with Jagdishpur P.S.Case No.134 of 2017 registered for an offence under Section 307 and ancillary Sections of the IPC. The allegation is that both the petitioners and others assaulted the informant by means of lathi.
Learned counsel for the petitioners submits that both the petitioners have clean antecedent except a case bearing Sabour (Goradih) P.S.Case No.323 of 2004 registered for an offence under Sections 147, 148, 323 and 341 of the IPC. He further submits that the petitioners are in custody since 02.11.2017.
Patna High Court Cr.Misc. No.60687 of 2017 (2) dt.19-12-2017 2/2 The learned APP opposed the submissions.
Considering the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Bhagalpur in connection with Jagdishpur P.S.Case No.134 of 2017.
