Petitioner, already in custody, seeks bail in connection with Chandan P.S. Case No.68 of 2017, registered under Sections 304(B)/34 of the Indian Penal Code.

Allegation in brief is that marriage of the deceased was performed with the petitioner one year back and she was being tortured in connection with demand of dowry and ultimately done to death.

Learned counsel for the petitioner submits that there is no external injury on the person of the deceased and the doctor has reserved the opinion till receipt of the viscera report. It is also submitted that the deceased got unconscious and as a result she fell down and sustained some injury.

No.55613 of 2017(3) dt.25-01-2018 2/2 Learned counsel for the State submits that the petitioner is husband and there is apparent external injury mentioned in the report and also ligature mark around the neck. Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Chandan P.S. Case No.68 of 2017, pending in the court of learned C.J.M., Banka.
