Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-08-2021 Heard learned counsel for the petitioner the State.

The petitioner seeks modification of the order dated 21.10.2020 passed by this Court in Criminal Miscellaneous No. 26462 of 2020. By the aforesaid order, the petitioner was directed to be enlarged on bail in the event of his arrest or surrender before the Court below within a period of eight weeks from the date of receipt/production of a copy of that order.

However, for the reasons which have been explained in the petition, the petitioner could not surrender within the period mentioned in the order dated 21.10.2020.

Patna High Court CR. MISC. No.25818 of 2021(2) dt.04-08-2021 2/2 The order dated 21.10.2020 is modified to the extent that in case the petitioner surrenders before the court below within a period of four weeks from today, he shall be accorded the privilege under the order dated 21.10.2020 with the same terms and conditions.

The order stands modified to the extent indicated above.

The modification application stands disposed of accordingly.
