Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.
Petitioner apprehends her arrest in connection with Muzaffarpur Complaint Case No. 1026 of 2017 in which cognizance has been taken for the offence punishable under Section 420 of the Indian Penal Code.
The complainant claims that he purchased one motorcycle (Moped) from Maa Agency but the aforesaid agency gave wrong registration number of his motorcycle. Submission on behalf of the petitioner is that
Patna High Court CR. MISC. No.20282 of 2020(2) dt.25-09-2020 2/2 petitioner was working as accountant in the aforesaid agency and she had no role in allotting registration number of purchased vehicle.
Although, learned Additional Public Prosecutor opposed the prayer but considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in Muzaffarpur Complaint Case No. 1026 of 2017, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
