The widow has filed the present writ application for payment of the family pension to her by the State Bank of India (for short 'the Bank').

A counter affidavit has been filed on behalf of the Bank. There is no rejoinder filed by the petitioner. Mr. Chaudhary has rightly pointed out from paragraph 5 of the counter affidavit that the grievance of the petitioner has been redressed. Paragraph 5 of the counter affidavit states as follows:

That it is respectfully submitted that the Bank has decided to start the payment of family pension to the petitioner w.e.f. 23.9.2016 as the petitioner is the legal wife of the deceased employee Sheshman Das. The petitioner has been paid family pension of Rs. 4215.69 on 23.9.2016 and since then Bank has been regularly paying family pension to the petitioner. Previous arrear of the family pension amounting to Rs. 2,17,725.00 has been paid to the petitioner on 25.10.2016."

The writ application is dismissed as having become infructuous.
