ANJANA MISHRA ORAL ORDER 20-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 13.02.2018 in connection with Wazirganj P.S. Case No. 5 of 2018 registered for the offences punishable under Sections 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that he was taken into custody on mere suspicion and, thereafter, made to give a confessional statement before the police which has no evidentiary value. It is further submitted that, till date, there has been no recovery from the possession nor has he been placed on the T.I. Parade. It is further pointed out that similarly situated accused persons have since been extended the privilege of bail passed in Cr. Misc. No. 29780 of 2018 vide order dated

Patna High Court Cr.Misc. No.46124 of 2018 (2) dt.20-08-2018 2/2 18.07.2018.

In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Gaya, in connection with Wazirganj P.S. Case No. 5 of 2018.
