JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-07-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioners and Smt. Asha Devi, the learned APP for the State. The present petition has been filed for modification of the order dated 06.12.2019 passed by this Court in Cr. Misc. No. 80384 of 2019 whereby and where-under the petitioners were granted the privilege of anticipatory bail, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of the said order.

No.18215 of 2020(2) dt.09-07-2020 2/2 The learned counsel for the petitioners submits that the petitioners could not surrender within the aforesaid period stipulated by this Court before the learned court below on account of illness of petitioner no.1, hence the time granted to the petitioners herein to surrender before the learned court below be extended.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to grant further eight weeks time from today to the petitioners to surrender before the learned court below in connection with Jamo Bazar P.S. Case No. 120 of 2019, pending before the learned Additional Chief Judicial Magistrate- XIII, Siwan, whereupon the petitioners shall be released on anticipatory bail in terms of the order dated 06.12.2019 passed in Cr. Misc. No. 80384 of 2019.
