Petitioners are apprehending their arrest in connection with Ishakchak P.S. Case No. 61 of 2018 for the offences registered under Section 413, 414/34 of the Indian Penal Code. Allegation against petitioners are that they were involved in theft of motorcycles and are also involved in sale and purchase of the said motorcycles.
It has been submitted on behalf of the petitioners that they are innocent and have committed no offence. They have been implicated in this case only on suspicion. Nothing has been recovered from their possession. They have no criminal antecedent. It has been further submitted that one similarly
Patna High Court Cr.Misc. No.48087 of 2018(2) dt.17-09-2018 2/2 placed co-accused, namely, Rahul Kumar @ Rahul Kumar Thakur has been granted anticipatory bail by co-ordinate Bench of this Court in Cr. Misc. No. 40935 of 2018 vide order dated 16.07.2018.
Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhagalpur in connection with Ishakchak P.S. Case No. 61 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (S. Kumar, J) Rajiv/Manoj U T
