The petitioner has moved the Court for the following reliefs:- "That the present writ petition is being preferred by opposing order of suspension passed by District Education Officer, Siwan communicated under memo no. 966 dated 10.08.2016 referring letter no. 567 dated 02.08.2016 issued under authority of District Programme Officer, Mid Day Meal, Siwan for certain irregularity committed including non-maintenance of cash book. It further indicated that vide letter no. 551

Patna High Court CWJC No.19645 of 2016 (2) dt.07-09-2017 2/2 dated 22.07.2016 punishment was imposed for deposit Rs.32, 543.16/- without any inquiry behind back and without appreciating factual and legal aspect and for other necessary relief/ reliefs to the basis of the facts and circumstances of case as enumerated and stated hereinabove."

3. As per the stand taken by learned counsel for the State before the Court today, the suspension of the petitioner was revoked vide Memo No. 1350 dated 29.11.2016 issued by the District Education Officer, Siwan.

4. In view thereof, learned counsel for the petitioner sought permission to withdraw the writ application.

5. Accordingly, the same stands dismissed as withdrawn.
