The petitioner seeks bail in connection with Ara Nawada Police Station Case No. 192 of 2017 registered for offences punishable under sections 302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act.
It has been submitted that the petitioner is neither named in the FIR nor any incriminating article has been recovered from his possession. His name surfaced during investigation in confessional statement of one of the FIR named accused Sethi Paswan who has been allowed bail by one of the coordinate Bench of this Court in Cr. Misc. No. 47199 of 2017 on 17.10.2017. Further submission is that the petitioner is in custody
Patna High Court Cr.Misc. No.60772 of 2017 (2) dt.20-12-2017 2/2 since 19.08.2017 having clean antecedent and so he also deserves bail.
Considering the facts and circumstances, as stated above, the prayer of bail is allowed and the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada Police Station Case No. 192 of 2017, subject to condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
