JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Tarapur P.S. Case No. 168 of 2019, registered under Sections 419 and 420/34 of the Indian Penal Code.

The accusation is that in course of the patrolling duty, when the informant and other police personnel reached at Urdu Chouck, Tarapur, near Bank of Baroda then two persons were seen in suspicious condition, who tired to flee away, but on chased they were apprehended. On query, both apprehended persons disclosed their names as Ashutosh Kumar (petitioner) and Gauri Shankar. On search, petitioner was found in possession of debit cards of different Banks and one mobile set and Gauri Shankar was also found in possession of one mobile set. On investigation, it was detected that petitioner has different accounts in Bank of Baroda, Bank of India and the State Bank of India and petitioner is unemployed. On query, petitioner disclosed that on asking by accused, Gauri Shankar, one Praveen Kumar @ P.K. managed to open his account in different Banks and he used to give Rs.5000/- for each debit card.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 09.11.2019 and the charge sheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.- IV, Munger, in connection with Tarapur P.S. Case No. 168 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
