Mrs. Arti Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 16-04-2025 Heard the learned counsel for the petitioner, learned APP appearing for the State and the learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Sanjhauli P.S. Case No. 200 of 2024 registered for the offence under Sections 190/191(1)/191(3)/76/103(1)/352/351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the deceased was pushed by the petitioner and his mother from the roof of the house after they have fought with the family of the deceased.

4. During investigation, though the family members of the deceased and the informant have said that the deceased was thrown from the roof by the accused persons but

Patna High Court CR. MISC. No.17368 of 2025(2) dt.16-04-2025 2/2 independent witnesses have said that after the fight, the petitioner was taken away by his mother from the house and no one saw the petitioner or his mother running away from the house. Petitioner is in custody since 19.11.2024.

5. From the materials available on record it appears to be a case of suicide by the victim girl and there is no independent material to show that she was pushed from the roof of the house by the petitioner.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Rohtas at Sasaram/concerned Court below in connection with Sanjhauli P.S. Case No. 200 of 2024.
