Rambha Devi. The latter filed a private complaint being Complaint Case No.1074 of 2013 before the court of learned Chief Judicial Magistrate, Sasaram at Rohtas, for the offence punishable under Section 498A of the Indian Penal Code. The parents of the petitioner were also shown as accused.

Apprehending arrest in that case, the petitioner filed an application for anticipatory bail being ABP No.1094 of 2014 before the Sessions Judge, Rohtas, Sasaram. The same was dismissed on 28.06.2014. Hence, this application for anticipatory bail under Section 438 of the Code of Criminal Procedure. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

It is rather unfortunate that differences between the

Patna High Court Cr.Misc. No.37426 of 2014 (2) dt.26-03-2015 2/2 petitioner and his wife have led to several proceedings. In fact, the petitioner and his parents filed Cr. Misc. No.38024 of 2014 for quashing the proceedings. The same was disposed of on 04.12.2014 referring the matter to the Mediation & Conciliation Centre of this Court.

The arrest of the petitioner would unnecessarily hamper for the resolution of the dispute between the parties and, on the other hand, it would further aggravate the situation. Hence, this application is allowed. In the event of arrest, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sasaram at Rohtas, in connection with Complaint Case No.1074 of 2013.
