JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-01-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody since 19.01.2022 in a case registered for the offences punishable under Sections 147, 148, 341, 323, 307, 354, 379, 504, 506 of the Indian Penal Code.
It is a case of assaulting due to which the informant's side sustained injuries. It is alleged against this petitioner that he assaulted with iron rod to the Mahendra Mahton on his head, eye and forehead. The father of the petitioner has filed a complaint against the informant and others by way of counter blast of this case. There is land dispute between the parties. There is no accusation of repeating the blow. The petitioner is in custody since 19.01.2022. Considering the facts stated above and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 2nd, Begusarai in connection with Birpur P.S. Case No. 137 of 2020.
