The petitioner seeks bail in connection with Sursand P.S. Case No. 114 of 2023 instituted for the offence under Sections 304(B) & 34 of the Indian Penal Code. Earlier vide order dated 23-08-2023, prayer of grant of anticipatory bail of the petitioner was rejected.

As per the prosecution case daughter of the informant was done to death at her matrimonial house. 4.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 30-01-2024. Petitioner has no criminal antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present
Patna High Court CR. MISC. No.21064 of 2024(2) dt.20-03-2024 2/2 case as being mother-in-law of the deceased. It is submitted that deceased was short tempered lady and for petty matter she herself has committed suicide. It is further submitted that petitioner is living separately from the family affairs of her son and his wife (deceased). There is delay of three days in lodging of the FIR. It is lastly submitted that there is no specific allegation against the petitioner.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and clean antecedent of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sursand P.S. Case No. 114 of 2023.
